Judge Extends Deadline for Consumers to File Proofs of Claim Against MV Realty

A judge for the United States Bankruptcy Court for the Southern District of Florida extended the deadline for consumers to file proofs of claim against MV Realty.

On Feb. 3, Judge Erik P. Kimball extended the deadline for consumers who signed MV Realty’s Homeowner Benefit Agreements to file proofs of claims until April 1, 2024.

Title agents and attorneys may have clients who should file a claim.

On Sept. 22, 2023, MV Realty and 35 affiliated companies filed for Chapter 11 bankruptcy protection in 33 states.

ALTA has identified at least 25,000 homeowners in 32 states who have been impacted by the predatory practice of filing unfair real estate fee agreements in property records, known as Non-Title Recorded Agreements for Personal Services (NTRAPS).

Under MV Realty’s Homeowner Benefit Agreement, a homeowner gives the company the right to list their homes for the next 40 years in exchange for a cash payment ranging from $300 to $5,000.
