FTC "Do Not Call" Enforcement On Again

The U.S. Court of Appeals for the Tenth Circuit, on October 7, 2003 , stayed a lower court ruling that stopped the FTC from enforcing the agency's National Do Not Call Rule. The Appeals court ruling set aside the order of the U.S. District Court for the District of Colorado that enjoined the enforcement of the Federal Trade Commission's (FTC's) Do-Not-Call Rule.

The Court of Appeals determined that the FTC would likely be able to show that the list directly advances the government's substantial interests to prevent telemarketers from engaging in abusive and coercive sales practices.

FTC Chairman Timothy J. Muris stated that the FTC will proceed to implement and enforce the Do Not Call Registry.
