ALTA® Alert: FTC Proposes Affiliate Information Sharing

Section 214 of FACTA added a new section 624 to the FCRA that prohibits a company that obtains certain information about a consumer from an affiliate from using that information in connection with its marketing of goods or services to the consumer unless it has first given the consumer the ability to opt-out of such solicitations.  The FTC was directed to promulgate implementing regulations by December 2004. The FTC has published proposed regulations (69 Fed. Reg. 33324 (June 15, 2004) on which comments are due by July 20, 2004.
