Use of Non-Attorneys in UPL States Could Impact Foreclosures

As servicers, lenders, and REO departments review their operation plans for 2011 and beyond in “attorney states,” they will need to disclose the risk of losing the right to foreclosure and other equitable remedies to their investors before choosing a non-attorney alternative in attorney states such as North Carolina and South Carolina.
