Do Exclusive Agency Agreements Violate RESPA 8(a)?

Ned Livornese, Maryland state counsel for Stewart Title Guaranty Co., provided today’s review of an order by the U.S. District Court for the Central District of California Western Division that addresses whether an underwriter’s exclusive referral agreement with a title agency violated RESPA 8(a) and its prohibition on kickbacks and referral fees.
