The Docket: 150-year-old Shellfish Bites Title Insurer

Ron Damashek of the Illinois law firm Stahl Cowen Crowley Addis LLC provided today’s review of a recent ruling by the state of Washington Court of Appeals that held a title insurer had a duty under an owner’s policy to defend the insured owner against a claimed right to harvest shellfish under a treaty signed more than 150 years ago, and lost its ability to deny coverage by failing to honor that duty.
