VA Requirements for Title Insurance and Attorney Opinion Letters

The U.S. Department of Veterans Affairs (VA) on Sept. 29 issued an update to its lenders handbook, which outlines lender approval guidelines.
In its update, the VA revised Subsection D to include attorney opinion letters. The handbook now notes that an attorney opinion letter—where appropriate for the jurisdiction—is not required. The VA has never required a lender making a VA loan or the Veteran-borrower to obtain title insurance.
According to the VA lender handbook, “The lender may apply its own title insurance requirements to VA loan transactions. VA requires only that title to the property meet the standards described above in “Estate of the Veteran in the Property.”
