Massachusetts Reforms Tax Foreclosure Law

Massachusetts Gov. Maura Healey signed a compromise budget that included an amendment to reform the state’s tax foreclosure process. The law reform was prompted by the 2023 U.S. Supreme Court ruling in Tyler v. Hennepin County, which held it is unconstitutional for a local government to take a property in a tax foreclosure and keep the excess surplus after the tax debt and costs are paid. ALTA, along with AARP and the National Consumer Law Center (NCLC), have issued recommendations for states to revise their laws to protect property owners from unnecessary tax foreclosures and promote sustainable homeownership.
