Encourage Your Senator to Pass TRID Hold-harmless Bill

Introduced by Sens. Tim Scott (R-SC) and Joe Donnelly (D-IN), S. 1711 would direct the Consumer Financial Protection Bureau to observe a temporary safe harbor for companies working in good faith to comply with TRID until Jan. 1, 2016. On Oct. 7, the House of Representatives passes a similar bill by an overwhelming bipartisan vote of 303-121.

ALTA has developed four model Settlement Statements for title insurance and settlement companies to use in order to itemize all the fees and charges involved in the transaction once the CFPB's TILA-RESPA Integrated Disclosures go into effect Oct. 3. Settlement statements are currently used in the marketplace in conjunction with the federal HUD-1. The model Settlement Statements are not meant to replace the Consumer Financial Protection Bureau's Closing Disclosure. Bank of America said it encourages settlement agents to use ALTA's model Settlement Statements or similar state-specific forms when needed to supplement the Closing Disclosure.

GSE Conforming Loan Limit Expected to Increase 3 Percent in 2016

Since the financial crisis began, any conversation about housing policy has inevitably included a discussion of GSE reform. The Protecting American Taxpayers and Homeowners Act, Johnson/Crapo reform bill and Administrative reform have all been discussed. Yet, one of the least discussed and most important features of the GSE relationship to the housing market is the conforming loan limit that restricts GSE lending based on the loan amount. The Federal Housing Finance Agency sets the loan limit for the upcoming year in late November. This year, the announcement is likely to be more important than in most recent years because it will likely be the first time in almost a decade that the conforming loan limit will be increased.

During its Oct. 8 meeting, the ALTA Board of Governors approved two revised closing protection letters (CPLs), decertified ALTA Endorsement 2-06 (Truth in Lending). The board also approved a joint survey standard developed with the National Society of Professional Surveyors, which is the successor to the American Congress on Surveying and Mapping. The comment period for the revised CPLs is open until Nov. 27.

The “white-collar” exemptions under the Fair Labor Standards Act (FLSA) have caused many headaches for employers, including those in the title insurance industry. Title companies of all sizes struggle to apply the regulations to the myriad of job descriptions within the field, and mistakes may prove costly should FLSA or state law litigation ensue. Compounding the problem, the U.S. Department of Labor’s guidance on the issue has been difficult to pin down, as the agency, on a number of occasions, has reversed its position of how the exemptions apply to certain jobs. Adding to the uncertain regulatory climate, the DOL in July issued a proposed rule that would increase the required weekly salary by more than 100 percent to $970 per week, or $50,440 annually, for employees to be exempt from the FLSA’s overtime provisions under most of the “white collar” exemptions.

Fannie Mae on Oct. 15 provided a list of frequently asked questions (FAQs) addressing compliance expectations with the Consumer Financial Protection Bureau’s TILA?RESPA Integrated Disclosures (TRID) rule. The FAQs address a range of issues including whether lenders use the ALTA Settlement Statement or the HUD-1 to assist in documenting the settlement charges, if Fannie Mae will require require borrowers’ and closing agents’ signatures in connection with the Closing Disclosure, and if discounts for a simultaneous title policy are considered an interested party contribution.

According to the CFPB, the creditor must deliver the Closing Disclosure to the consumer at least three business days prior to the date of consummation of the transaction. However, the CFPB said creditors may use settlement agents to provide the Closing Disclosure, provided that the settlement agents comply with the final rule’s requirements for the Closing Disclosure. The Consumer Financial Protection Bureau’s final rule for new integrated mortgage disclosures doesn’t simply combine two disclosures. It merges to federal regulations as well. The new Loan Estimate and Closing Disclosure, which go into effect Aug. 1, 2015, will require changes to internal operations and procedures, technology platforms, business strategies and processes, and partnerships with lenders and real estate agents.
