FHFA Increases 2020 Maximum Conforming Loan Limits to $510,400

Deadline Jan. 21 to Submit TRID Comments to CFPB

The Consumer Financial Protection Bureau (CFPB) is requesting public comment on an assessment it will conduct on the TRID Integrated Disclosure Rule (TRID). As part of its assessment, the CFPB intends to address the TRID Rule’s effectiveness in meeting the purposes and objectives of Title X of the Dodd-Frank Act, the specific goals of the rule and other relevant factors. ALTA submitted a letter urging the bureau to add questions to a survey it plans to send to title professionals and consumers.

 Fidelity Reports Third-quarter Results

Fidelity National Financial reported that its title insurance segment generated pre-tax income of $339 million during the third quarter of 2019. This compared to $311 million in pre-tax income reported during the same period a year ago. This was Fidelity’s strongest third quarter since 2003.

To help on this front, the U.S. House of Representatives passed the ALTA-supported Corporate Transparency Act, which would require corporations and limited liability companies to reveal beneficial owners to the federal government when they’re formed.

Napa County Rejects IRS Fee Decrease to File Federal Tax Liens

In an undated letter received on Sept. 24, 2019, the Internal Revenue Service (IRS) announced that effective Oct. 1, 2019 it was lowering the fees it would pay for recording federal tax liens and releases. Napa County responded to the IRS by refusing to record those documents until the correct fees are paid.

The buyers' claim against a title agent that it was "professionally negligent" in failing to secure a valid access easement for the insured property was not barred by the three-year statute of limitations, because the agent "represented" that the property had access, extending the time to sue until the buyer discovered the problem. Also, the court said the buyers could not sue the title agent for malpractice, but they might have a valid claim for negligent procurement of insurance.

According to the report, "One issue involved institutions that purportedly leased offices or desk space from realtors and home builders, where the amounts paid to realtors and home builders greatly exceeded the fair market value of the rentals. Another issue involved desk rentals that appeared to be sham or subterfuge arrangements to disguise the payment of impermissible mortgage referral fees."

Maryland Governor Signs RON Bill

Maryland Gov. Larry Hogan recently signed Senate Bill 678 into law enabling remote online notarizations (RON). In April, Maryland’s legislature passed the bill, which modifies the state’s Uniform Law on Notarial Acts and allows for remote online notarization for real estate transactions. The legislation will go into effect Oct. 1, 2020.

Anti-Money Laundering Bill Passes Committee With ALTA Changes

The initial discussion draft of "Coordinating Oversight, Upgrading and Innovating Technology, and Examiner Reform Act of 2019" included a provision to expand the FinCEN Geographic Targeting Orders to cover commercial real estate transactions on the same terms as residential transactions (e.g. cash purchases over $300,000). Also included was a provision to affirmatively cover transactions made using a like kind exchange. Due to efforts by ALTA members and staff, edits were made to the language requiring FinCEN to issue a unique GTO on commercial real estate.
How Have the 2017 Tax Law Changes Impacted Real Estate Prices?

Enacted in 2017, the Tax Cuts and Jobs Act reduced tax breaks for homeowners. At the time, many in the real estate industry expected the changes to negatively impact the housing market, particularly in high-priced neighborhoods. The industry concern primarily focused on two specific changes included in the bill: the mortgage interest deduction was limited to loans of $750,000 or less, down from a previous cap of $1 million, and the deduction for state and local (property) taxes was capped at $10,000. The Consumer Financial Protection Bureau (CFPB) on March 4 issued an Advance Notice of Proposed Rulemaking (ANPR) to get feedback on residential Property Assessed Clean Energy (PACE) financing. PACE loans allow homeowners to pay for energy-efficient retrofitting through their property tax assessments. These loans often take lien priority over the first mortgage lien. ALTA said PACE programs need effective safeguards that will promote energy efficiency property upgrades, while also protecting consumers.

 New York Reminds Title Companies of New Regs, Rate Requirements

The regulations require title insurance companies to submit new rate applications to establish rates to be charged in the future that exclude all expenses deemed to be prohibited under the regulation.
