Under the agencies’ proposal, traditional navigable waters, tributaries to those waters, certain ditches, certain lakes and ponds, impoundments of jurisdictional waters and wetlands adjacent to jurisdictional waters would be federally regulated. ALTA Says Any Plan to Reform Housing Finance System Must Preserve Uniform Underwriting Standards

On Sept. 6, U.S. Rep. Jeb Hensarling (R-Texas) unveiled a reform plan that would repeal the charters of the government sponsored entities (GSEs). In response, ALTA said that any plan to reform the U.S. housing finance system must preserve the uniform standards currently provided by the Freddie Mac and Fannie, including title insurance.

Fidelity National Financial reported that its title division generated adjusted pre-tax earnings of $338 million during the second quarter of 2018. California Data Privacy Law Impact on Business

California’s sweeping data privacy Law signed into law in June will apply to more than 500,000 companies in the United States when it goes into effect Jan. 1, 2020. The California Consumer Privacy Act of 2018 gives consumers control over their personal information including the right to know what information companies are collecting about them, how it is used and if it is sold to third parties. Consumers will also have the right to prohibit companies from sharing their personal data.
Judge Grants Stay to Delay Implementation of New Financial Interest Form in Illinois

Attorneys’ Title Guaranty Fund Inc. prevailed in its request for a stay of implementation of a revised disclosure of financial interest form (DS-1) developed by the Illinois Department of Financial and Professional Regulation (IDFPR). The judge found compelling ATG’s argument that attorneys should not be required to disclose their fees to third parties and that the IDFPR does not have the authority to regulate attorneys’ fees.

Bureau Won’t Appeal Borders & Borders RESPA Decision

The Bureau of Consumer Financial Protection (Bureau) has decided not to appeal a 2017 decision by a federal judge who ruled that Kentucky-based law firm Borders & Borders did not violate the Real Estate and Settlement Procedures Act (RESPA). Speaking during ALTA’s Advocacy Summit in Washington, D.C., acting Director Mulvaney told attendees that, despite the decision not the appeal, he did not agree with everything in the District Court’s order. He reaffirmed that the Bureau will still enforce RESPA, but that everyone has the right to know what the law is “before we come after you.”

Survey Shows TRID Helping With Borrower Satisfaction

The Stratmor Group notes that despite the increase in loan cost and longer closing cycle, borrower satisfaction has improved. Stratmor attributes this increase to the fact that more lenders are contacting consumers prior to closing. Increased contact between the borrower and lender was one of the key goals of TRID.
CFPB Seeks Comments on Investigation Process

The Consumer Financial Protection Bureau (CFPB) published a request for information (RFI) on Jan. 24 seeking comment on the bureau's process for investigating companies that face possible enforcement actions. A day after issuing the request, CFPB Acting Director Mick Mulvaney laid out the bureau’s new governing philosophy in a staff memo, which said that regulated businesses should have the right to know the rules before being charged. “This means more formal rulemaking on which financial institutions can rely, and less regulation by enforcement,” Mulvaney wrote.
