Number 10: Federal Judge Tosses Suit Accusing Title Company of Age Discrimination

A federal judge in a June ruling dismissed a case alleging a title company in Texas fired a woman because she refused to dye her hair. In the U.S. District Court Southern District of Texas Houston Division, Judge Gray H. Miller approved Capital Title of Texas’ motion for summary judgment and threw out Sandra Rawline’s lawsuit alleging age discrimination. “The court finds absolutely no evidence that Rawline’s age was a motivating factor for her discharge,” Miller wrote in this ruling. “Any reference to Rawline’s hair color occurs only in the context of her overall disheveled appearance and offers no support for Rawline’s allegation that Capital Title intentionally discriminated against her because of her age.”
Number 9: ALTA Urges CFPB to Preserve Role of Independent Third-party Settlement Agents

ALTA submitted a letter Nov. 6 to the Consumer Financial Protection Bureau (CFPB) sharing concerns about the bureau’s proposed regulations to combine the overlapping federal disclosure forms required by RESPA and TILA. While ALTA supports the CFPB’s efforts to streamline disclosures and make them easier for consumers to locate key information, the proposed rule will dramatically alter the settlement process and harm consumers. The best thing that the bureau can do to protect consumers in a mortgage transaction is to maintain the role settlement agents currently play as an independent third party to the transaction. However, the current proposal will have unintended consequences of limiting consumer choice, concentrating risk among fewer settlement providers and potentially eliminating the role of the independent third-party settlement agent. The impact of these outcomes on consumers could be devastating, ALTA said in its letter.
Number 8: U.S. Supreme Court Dismisses First American v. Edwards

The U.S. Supreme Court on June 28 dismissed the First American Financial Corp. v Edwards lawsuit, which was addressing if consumers can bring class action lawsuits under the Real Estate Settlement Procedures Act (RESPA) even if they never suffered some actual injury. The case, which was argued in November, came to the court from the U.S. Court of Appeals for the Ninth Circuit. Without elaborating, the justices dismissed the case in a brief order that said “The writ of certiorari is dismissed as improvidently granted.” In effect, this means the court said it should not have accepted the case. The Ninth Circuit’s ruling stands and the case will be remanded back to the district court for discovery and trial. By dismissing the case, the U.S. Supreme Court left the issue to be worked out in the trial court and leaves the issue of the necessity of injury to bring a class action suit unresolved.

Number 6: The Docket: Federal Court Rules in Case Accusing Title Company of 'Upselling'

Raighne C. Delaney of the law firm Bean, Kinney & Korman and a member of ALTA’s Title Counsel, reviewed the U.S. district court’s decision in the Ohio lawsuit Trohoske v. Chicago Title Insurance Co., which addressed accusations that a title company and its issuing agent of selling a more expensive policy to an Ohio homebuyer. This case is important because it is another rejection of class action suits against title insurers; it validates a practice of advising potential insureds on a superior, but more expensive, type of title insurance; and makes clear that the industry should advise potential insureds about all of the material differences between the alternative types of title insurance.
Number 5: Market Demands on Lenders Impacting Settlement Service Providers

This was the first of a series of articles discussing the recent focus of holding lenders responsible for actions of their service providers. Recent bulletins and consent orders from the Federal Reserve, Consumer Financial Protection Bureau (CFPB) and Office of the Comptroller of the Currency (OCC), and requirements for more oversight of foreclosure practices by lenders and servicers coming out of the national mortgage servicing settlement all point to increased focus on service providers and holding lenders responsible.
Number 4: Deadline to Give Feedback on Proposed New HUD-1

The deadline to provide feedback on the Consumer Financial Protection Bureau’s (CFPB) integrated disclosure, which will result in a new GFE and HUD-1, was April 16. The CFPB had released prototypes for a Loan Estimate (which will replace the GFE) and the Settlement Disclosure (which will replace the HUD-1). In July, the CFPB published more than 1,000 pages of regulations that go with the forms. A 90-day comment period ended in November.
Number 3: Title Agents, Settlement Service Providers Respond to Requests from Third-party Vetting Companies

This was the second in a series of articles looking at new market demands holding lenders responsible for actions of their service providers and the creation of settlement agent vetting companies. Consequently, regulators’ increased demand to protect consumers has forced lenders to adjust their relationships with service providers and be more sensitive to the types of companies they do business with. To help meet this need, ALTA has created a set of best practices called Title Insurance and Settlement Company Best Practices to help members highlight practices the industry exercises to protect lenders and consumers, while ensuring a positive and compliant real estate settlement experience.
Number 1: Watch Lifetime’s Feature on Title Insurance and the Home Closing Process

ALTA partnered with the "Designing Spaces" television series on Lifetime to explain to homebuyers the closing process and the importance of purchasing an owner’s title insurance policy. The segment titled "Protecting Your Best Investment," first aired on April 26 with a replay on June 1. The segment shows how one homebuyer’s experience went smoothly thanks to the help of title professionals who complete many behind-the-scenes steps in order to place the keys to the house in the hands of the new owner. Representing the industry, ALTA past president Anne Anastasi explains to the homebuyer, played by Marlen Rodriguez of Universal Land Title, that consumers have the option to shop around for their settlement agent to handle their transaction. Since the show reaches more than a million potential and current homebuyers, it represented one of the biggest chances we’ve had to make our case to the general public.
