CFPB Report Suggests States Eliminate GLBA Carveout to Consumer Privacy Laws

Old Republic Reports Third-quarter Results
Old Republic International reported its title insurance division generated $40 million in pretax income during the third quarter of 2024. This compared to $37 million in pretax income during the same period a year ago.

Builder to Acquire Alliant National Title
Colorado-based underwriter Alliant National Title Insurance Co. and a related affiliate entered into a definitive agreement to be acquired by Florida-based Dream Finders Homes. Alliant National Title generated $58 million in title insurance premium through the first half of 2024, according to the latest market share data provided by ALTA. The underwriter operates in 32 states and Washington, D.C., through a network of more than 100 title agencies.
The Docket: District Court Denies Challenge to Corporate Transparency Act
The U.S. District Court for the Eastern District of Virginia denied the Community Association Institutes motion for preliminary injunction in its challenge to the Corporate Transparency Act (CTA). The lawsuit challenges the constitutionality of the act and Financial Crimes Enforcement Network’s (FinCEN) interpretation of the exemption for nonprofits. Earlier this year, a district court in Alabama held the law was unconstitutional.
DomiDocs Upgrades Property Fraud Protection System
According to DomiDocs, many U.S. companies and counties offer home title locking and monitoring services, but these are typically reactive, only alerting homeowners after fraud has already occurred. The company said its HomeLock 3.0+AI takes a proactive approach, scanning public and private databases, purchase and sale sites, social media, and rental sites by parcel number and address to detect fraud with advanced algorithms.

FinCEN Renews Real Estate Geographic Targeting Orders
The Financial Crimes Enforcement Network (FinCEN) on Oct. 15 renewed its Geographic Targeting Orders (GTO) that requires U.S. title insurance companies to identify the natural persons behind shell companies used in non-financed purchases of residential real estate. The terms of the GTOs are effective through April 14, 2025. FinCEN issued a final rule requiring certain industry professionals to report information to FinCEN about non-financed transfers of residential real estate to a legal entity or trust. This nationwide reporting framework will replace the GTOs and will go into effect on Dec. 1, 2025.

FHA Reports HUD Second Liens Are Being Missed

2024 Second Quarter Title Insurance Industry Market Share Executive Summary
Title Insurance Industry Market Share and Financial Statement compilations for the 2nd Quarter of 2024 are now available on the ALTA website. The second quarter of 2024 was a positive quarter for the title insurance industry. Title Insurance Premiums Written were up 4.2% from the second quarter of 2023. Total Operating Income was up 3.5%.

The title insurance industry generated $4.09 billion in title insurance premiums during the second quarter of 2024. This compared to $3.92 billion during the same period a year ago, according to ALTA’s latest Market Share Analysis.

Title Companies Should Adjust Business Strategies Due to NAR Settlement
The proposed $418 million settlement agreement the National Association of Realtors (NAR) reached to end litigation of claims brought on behalf of home sellers related to broker commissions is still subject to final court approval. Plaintiffs have requested a hearing on final approval of the settlement to be held on Nov. 26. Until then, the impact on the title industry will probably not be immediately seen, but title companies should see this as an opportunity to support and assist real estate brokerages and showcase their value proposition.

FinCEN Issues Final Anti-Money Laundering Rule for Real Estate
The U.S. Treasury Department’s Financial Crimes Enforcement Network (FinCEN) issued a 120-page final rule that requires certain people involved in real estate closings and settlements to report information to the agency about all-cash residential transactions nationwide involving legal entities and trusts. The effective date of the rule is Dec. 1, 2025. ALTA had asked for a one-year implementation period at a minimum. CFPB Says Contracts for Deed Must Comply With TILA
The Consumer Financial Protection Bureau (CFPB) issued an advisory opinion affirming that federal home lending rules and laws under the Truth in Lending Act (TILA) cover contracts for deed and provide key consumer protections. In its research report, the CFPB includes a note highlighting the importance of title insurance. The report note says, “Title problems are extremely common in land contract transactions. ... A simple warranty of title from the seller does not provide the buyer with the same protections that they would have under a traditional mortgage, where the lender would require the buyer to purchase title insurance."

FTC Noncompete Ban Goes Into Effect in September

Massachusetts Reforms Tax Foreclosure Law
Massachusetts Gov. Maura Healey signed a compromise budget that included an amendment to reform the state’s tax foreclosure process. The law reform was prompted by the 2023 U.S. Supreme Court ruling in Tyler v. Hennepin County, which held it is unconstitutional for a local government to take a property in a tax foreclosure and keep the excess surplus after the tax debt and costs are paid. First American Financial Corp. reported its title insurance segment generated pretax income of $177.4 million during the second quarter of 2024. This compared to $185.7 million in pretax income during the same period a year ago.
Old Republic Reports Earnings for Second Quarter of 2024
Old Republic International Corp. reported its title insurance segment generated pretax income of $46.0 million during the second quarter of 2024. This is up from $34.7 million in pretax income during the first quarter of 2023.

14 Attorneys General Urge FHFA to Terminate Title Waiver Pilot
Led by Tennessee Attorney General Jonathan Skrmetti, a coalition of 14 attorneys general sent a letter to the Federal Housing Finance Agency (FHFA) expressing concerns over their revived pilot program aimed at removing title insurance requirements from certain loans sold to Fannie Mae. The letter said "Title insurance is a state-regulated industry, and homeowners will be better served if it stays that way. We call on the Agency to terminate implementation of this misguided pilot program."
Founder and CEO of DocMagic Passes Away
Dominic Iannitti, founder and chief executive officer of DocMagic, unexpectedly passed away July 18 due to complications from pneumonia. He founded the company in 1987 with a vision to streamline the mortgage process and ultimately eliminate the reliance on paper.

Treasury Proposes Rule to Expand Review of Real Estate Transactions Near Military Installations
This proposed rule would add over 50 military installations, across 30 states, to the existing list of installations around which CFIUS has jurisdiction, including over land purchases. This latest update would vastly expand the reach of CFIUS’s real estate jurisdiction. Given the importance of real estate to the U.S. economy, ALTA believes any law regarding foreign ownership should establish specific processes and procedures to protect valid property interests and avoid penalizing legitimate sellers, creditors and future owners of property.

Federal, State Legislators Question Title Waiver Pilot

Fidelity Reports Q1 2024 Results
Fidelity National Financial reported that its title insurance segment generated pretax earnings of $218 million during the first quarter of 2024. Title Insurance Premium Volume Decreased 31% in 2023, ALTA Reports
As mortgage originations contracted last year, so did title insurance premium volume. According to ALTA’s Market Share Analysis, the title insurance industry generated $15.1 billion in title insurance premiums during 2023, a 31% decrease compared to 2022.
